Seed Warranty - Outsidepride Seed Source, LLC warrants that seed sold is of high quality, that seeds are as described on the container within recognized tolerances in the trade, that seeds have been described as required under State and Federal Seed Laws, and that seeds have been tested by a Registered Seed Technologist. This is the sole warranty; we make no other, express or implied. We cannot guarantee establishment of seed due to various factors over which we have no control. Many seeds are very tiny and a hard rainfall, planting too deep, soil pH, not keeping the seed moist, cold temperatures, and other environmental factors may hinder success. Outsidepride DOES NOT guarantee the germination of seed. Liability (ie. wrong seed was sent), whether contractual, for negligence or otherwise, is limited in all respects to the amount of the purchase price of the seeds, regardless of the nature, cause or extent of the loss. It is expressly agreed that this limited remedy is exclusive and that we shall not be liable for any damages over and above the purchase price of this product. And as a condition to any liability on our part, we must receive notice by registered mail of any claim.

Pictures of plants, flowers, grass, etc. as well as height, width, bloom colors, etc. are all approximations. Genetic variance, pigment flow, soil pH, minerals in soils, sunlight, age of plant, shift in pollinators, and moisture can all affect: color, height, width, etc. over which we have no control. Most pigments are water soluble (or soluble in plant sap) and therefore they are transported via the veins and deposited in specific locations. Anything that affects the production of pigments or disrupts its destination can result in one flower or group of flowers on the same plant taking on a different concentration or distribution of pigment. Often as not, flowers on the same plant are not identical in amount and distribution of pigment. Research indicates that the changes in color are based on the destruction of key genes through mutation in the DNA. The loss of a key gene in the pigment production pathway results in a “hiccup” in the normal system. As you can see, many factors control the color of a flower or plant.

IMPORTANT NOTICE REGARDING RISKS AND SEED BORNE DISEASES: Failure of seed to germinate and/or other yield reduction may occur as a result of multiple environmental and agronomic factors, including, without limitation weather conditions, soil conditions, and the use of chemicals and fertilizers. Seeds at times may carry seed borne pathogens. Precautions and/or seed treatments cannot assure complete immunity from seed borne pathogens, and under present technology it is impossible to guaranty that any particular seed which is sold by Seller is free from a seed borne pathogen. SELLER OFFERS NO WARRANTY REGARDING SEED BORNE DISEASE, EITHER EXPRESSED OR IMPLIED, AND NONE SHOULD BE ASSUMED FROM ANY LANGUAGE HEREIN, REGARDLESS OF WHETHER OR NOT SPECIAL TREATMENTS ARE APPLIED TO THE SEED TO PREVENT SEED BORNE PATHOGENS. ALL RISKS OF NONPERFORMANCE, REDUCED PERFORMANCE AND/OR CROP DAMAGE DUE TO SEED BORNE PATHOGENS SHALL BE ASSUMED BY BUYER.

NOTICES TO BUYER REGARDING LIMITATION OF WARRANTY AND LIMITATION OF LIABILITY: PLEASE READ THESE NOTICES BEFORE PLANTING THE SEED If you do not agree with the below stated Limitation of Warranties and Limitation of Liability, do not plant the seed purchased from Seller, but rather return the seed to Seller within 20 days of purchase for a refund of the purchase price. LIMITATION OF WARRANTY: Seller warrants that all seed sold has been labeled as required under applicable State and Federal seed laws and that the seed conforms to the label description within recognized tolerances. THE FOREGOING WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE DESCRIPTION ON THE LABEL. BUYER’S EXCLUSIVE REMEDY FOR ANY CLAIM OR LOSS RESULTING FROM BREACH OF WARRANTY, BREACH OF CONTRACT, OR NEGLIGENCE (WHICH SHALL NOT EXTEND TO INCIDENTAL OR CONSEQUENTIAL DAMAGES) SHALL BE LIMITED TO REPAYMENT OF THE PURCHASE PRICE FOR THE SEED. NO AGENT, EMPLOYEE OR REPRESENTATIVE OF SELLER HAS ANY AUTHORITY TO BIND THE SELLER TO ANY AFFIRMATION, REPRESENTATION OR WARRANTY CONCERNING THE SEED. ANY SUCH AFFIRMATION, REPRESENTATION OR WARRANTY MADE BY AN AGENT, EMPLOYEE OR REPRESENTATIVE OF SELLER ABOUT THE SEED SHALL NOT BE ENFORCEABLE BY BUYER OR ANY OTHER PERSON. Any advice furnished to Buyer or any other person concerning the use of the seed or relating to the production of crops from the seed may not be relied upon by Buyer, and constitutes only suggestions and general information, not representations or warranties. The production of crops from seed is subject to a multitude of variables which cannot be known or controlled by the Seller.

LIMITATION OF LIABILITY: Seller’s sole express warranty to the Buyer is that the seed that Seller sells will conform to those descriptions of said seed that are required to be on the label by applicable State and Federal seed laws within recognized tolerances. SELLER DISCLAIMS AND DOES NOT MAKE ANY OTHER WARRANTIES, EXPRESSED OR IMPLIED. NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IS MADE. THERE ARE NO GUARANTEES OR WARRANTIES THAT THE SEED WILL BE FREE FROM SEED BORNE DISEASES AND LIABILITY FOR SUCH DISEASES IS DISCLAIMED.

BUYER’S SOLE AND EXCLUSIVE REMEDY FOR ANY LOSS OR DAMAGES ARISING FROM THE USE OF THIS SEED SHALL BE THE REPAYMENT OF THE PURCHASE PRICE OF THE SEED. SELLER AND ITS SALES AGENTS SHALL NOT BE LIABLE FOR LOST PROFITS OR ANY OTHER SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES THAT ARISE FROM THE USE OF THE SEED. THIS LIMITATION OF LIABILITY APPLIES TO ALL CLAIMS FOR DAMAGES, INCLUDING CLAIMS BASED UPON NEGLIGENCE, BREACH OF WARRANTY, BREACH OF CONTRACT, OR ANY OTHER LEGAL THEORY.

CLAIMS: Buyer agrees to promptly notify Seller in writing regarding any claims that the seed sold by Seller does not meet the description on the label, and to provide Seller with an opportunity to visually inspect and sample the seed, and any plants or crops derived therefrom, in order to verify any claims made by Buyer. Buyer agrees that all such claims will be presented to Seller within a reasonable amount of time after discovery of any defects alleged by Buyer. In any event, Buyer agrees that the period to present any such claims to Seller shall expire within thirty (30) days after the date of discovery of the alleged defect in the seed. After investigation of a claim that is presented in a timely manner in accordance with the procedures set forth above, and confirmation that the claim is valid, Seller shall provide Buyer with a refund of the purchase price of the seed.

Other Products/Returns - If you are unsatisfied with your product, you may return the unused product within 30 days from the date of purchase for a refund on the purchase price of the product less a 15% return fee as long as the product is returned in it's original package and has NOT been removed or assembled for use. No shipping charges will be refunded even on free shipping items. The cost of shipping the freight to you will be deducted from your refund. If you decide you do not want an order after it has already been shipped out and you refuse the order without asking permission you will be charged the 15% restocking fee and your shipping charges will NOT be refunded. Seed returns must be in the original bag/package and be unopened. Any discrepancies, damages, or uncleanliness could result in a delay or partial forfeiture of your credit. We cannot accept any returned electrical merchandise including mowers. All transportation charges on products submitted for replacement or refund under this warranty must be borne by the purchaser. No shipping charges will be refunded. There are no other expressed warranties.

If you have not received your product, you need to have notified us within 30 days from the date of purchase.

To return your product follow the procedures below:

• 1. Save the box, invoice and packaging materials
• 2. Email support@outsidepride.com to request an RMA number.
• 3. All returns must be in the original box, include the invoice and have an RMA number issued and posted on the return label (not written on box). We will notify you of the return address when we give you the RMA number.

Note: The information on any page of www.outsidepride.com is subject to change without notice or obligation including all: text, pictures, and prices, etc. Substitutes may be shipped of equal or greater value in case of out of stock items or seed varieties that change. If particular seed varieties do not conform to our high standards for purity and germination, they will be substituted for a variety of equal or better performance. Seed varieties are not always available so they may be substituted for a different variety if necessary.  Flower colors in mixtures may also change due to poor germination of certain  colors.  Pictures on this web site are our best effort to represent what we are selling, but due to factors out of our control they may not be 100% accurate.
